These Terms of Service govern your access to and use of MaidServSA. By creating an account, posting a job, applying for work, messaging other users, or otherwise using the platform, you agree to these terms.

1. Acceptance of Terms
- MaidServSA provides an online marketplace for domestic cleaning opportunities in South Africa.
- These terms apply to all users, including CLIENT, MAID, and ADMIN accounts.
- If you do not agree with these terms, you must not use the platform.
2. Definitions
- Platform: The MaidServSA web application, API, and related services.
- CLIENT: A user who posts jobs and engages domestic workers.
- MAID: A user who applies for and performs jobs.
- ADMIN: A platform administrator with moderation and oversight permissions.
- Job: A listing created by a CLIENT for domestic work.
- Application: A MAID's response to a Job.
- Content: Text, messages, images, files, reviews, and profile information submitted by users.
3. Eligibility
- You must be at least 18 years old to use MaidServSA.
- You must have the legal capacity to enter binding agreements in South Africa.
- You are responsible for ensuring your use of the platform complies with applicable law, including immigration, employment, and tax requirements where relevant.
4. Accounts and Security
- You must provide accurate account information and keep it updated.
- You are responsible for all activity performed through your account.
- Passwords are stored using industry-standard secure hashing, never in readable form, but you remain responsible for keeping your credentials confidential.
- You must notify support immediately if you suspect unauthorized use.
5. User Roles and Obligations
5.1 CLIENT obligations
- Post lawful, accurate job information.
- Use respectful communications.
- Make payment arrangements directly with the MAID.
- Rate honestly after completed jobs.
5.2 MAID obligations
- Provide truthful profile, CV, and experience information.
- Apply only to jobs you intend to perform.
- Perform accepted work professionally and lawfully.
- Communicate respectfully and safely through platform channels.
5.3 ADMIN powers
- Review reports.
- Moderate message/rating content.
- Suspend accounts for policy breaches.
6. Job Lifecycle
Jobs on MaidServSA follow these statuses:
Open → In progress → Completed
Alternative end states:
Open → Cancelled, and Open → Expired
Key rules:
- Jobs are generally editable while Open.
- Accepting an application moves a job to In progress and assigns a MAID.
- Messaging is available to participants while a job is In progress.
- Ratings become available after completion.
7. Payments
- MaidServSA does not process payments or hold funds.
- Payment is agreed and settled directly between CLIENT and MAID.
- Job pricing supports fixed and hourly models.
- Currency references use South African Rand (R / ZAR).
- Users are responsible for receipts, proof of payment, and tax compliance.
8. Intellectual Property and AI Content
- The MaidServSA platform, branding, and software remain MaidServSA intellectual property.
- You retain ownership of your own submitted content, but grant MaidServSA a non-exclusive right to host and display it to operate the service.
- AI-assisted outputs (for example job descriptions and application drafts) are suggestions only. You must review and approve content before use.

9. Prohibited Conduct
You may not:
- Engage in fraud, misrepresentation, or impersonation.
- Harass, threaten, or discriminate against other users.
- Post unlawful, abusive, or harmful content.
- Manipulate ratings/reviews or submit false reports.
- Attempt scraping, reverse engineering, or unauthorized access.
- Use the platform for unrelated advertising or spam.

10. Suspension and Termination
- MaidServSA may suspend or terminate accounts that violate these terms, law, or platform policies.
- We may remove or restrict content pending investigation.
- You may request account closure via
support@maidservsa.co.za.
11. Disclaimers and Liability Framework
- MaidServSA is a facilitator marketplace, not an employer, staffing agency, or insurer.
- Service quality, attendance, and payment performance remain the responsibility of contracting users.
- Liability limits and disclaimer details are set out in the Liability Disclaimer.
- Disputes are handled under the Dispute Resolution Policy.
12. Changes to Terms
- We may update these terms to reflect legal, technical, or operational changes.
- Updated terms apply when published with a revised date.
- Continued use after updates indicates acceptance.
13. Governing Law and Jurisdiction
- These terms are governed by South African law.
- Where applicable, this includes the Electronic Communications and Transactions Act, 2002 (ECTA) and the Consumer Protection Act, 2008 (CPA).
- Disputes may be brought in competent South African forums and courts.
