This Service Agreement outlines the commercial relationship framework between MaidServSA users for domestic work engagements.

1. Parties and Scope

  1. This agreement applies to:
    • MaidServSA (platform operator)
    • CLIENT users posting work
    • MAID users applying for and performing work
  2. Each accepted job creates a direct service relationship between CLIENT and MAID.

2. Platform Role

  1. MaidServSA acts as a facilitator marketplace only.
  2. MaidServSA is not the employer of MAIDs and does not supervise day-to-day work performance.
  3. MaidServSA does not process wages, payroll, statutory deductions, or employee benefits.

3. Job Agreement Process

3.1 Posting and applications

  • CLIENT posts a job with scope, dates, location, and pricing model.
  • MAID submits an application.
  • CLIENT may accept or reject applications.

3.2 Status lifecycle

Job flow follows:

Open → In progress → Completed

Possible alternatives:

Open → Cancelled, or Open → Expired

3.3 Execution period

  1. Once accepted, the MAID and CLIENT coordinate through platform messaging.
  2. The parties must complete the work to the agreed scope and schedule.
  3. If no acceptance occurs before relevant dates, jobs may expire automatically.

4. Payment Terms

  1. Payment is arranged directly between CLIENT and MAID.
  2. Platform-supported pricing types:
    • Fixed
    • Hourly
  3. Currency is South African Rand (R / ZAR) unless users explicitly agree otherwise.
  4. MaidServSA does not hold escrow, collect commissions from direct payment transfers, or guarantee payment completion.

5. Ratings and Feedback Obligations

  1. Both CLIENT and MAID can rate one another after completed work.
  2. Ratings use a 1-5 scale with optional written reviews.
  3. Editing is time-limited (default 24-hour window, configurable by platform policy).
  4. Abusive or fraudulent reviews may be moderated or hidden after review.

6. Independent Contractor Status

  1. MAIDs remain independent service providers.
  2. Nothing in this agreement creates an employment contract between MaidServSA and MAIDs.
  3. Users remain responsible for compliance with South African legal requirements that may apply to domestic work arrangements, including:
    • Basic Conditions of Employment Act (BCEA)
    • Sectoral Determination 7 (Domestic Worker Sector)
    • National Minimum Wage Act

7. Insurance and Risk Allocation

  1. Users are responsible for their own insurance arrangements where appropriate.
  2. CLIENT and MAID should agree in advance on access, safety, tools, and risk controls.
  3. MaidServSA does not provide insurance cover for property damage, injury, theft, or wage disputes.

8. Suspension and Termination

  1. MaidServSA may suspend access for policy violations or safety concerns.
  2. Either party may stop using the platform at any time, subject to existing contractual obligations between CLIENT and MAID for accepted work.
